BY THIS AGREEMENT made and entered with Destin Memories, LLC herein referred to as Lesser, and herein referred to as Lessee, Lesser rents to Lessee the premises situated at , Sandestin, State of Florida together with all appurtenances for a term of nights, commencing on after 4:00 PM and ending on at 10:00 AM.

1. Rent. Lessee agrees to pay to Lesser, as rent, the sum of (ALL INCLUSIVE). The full payment is due IMMEDIATELY.

2. Processing Fee/Damage Insurance. A non-refundable processing fee which is included in the amount above also provides accidental damage insurance for up to $1500.

3. Quiet Enjoyment. Lesser covenants that on paying the rent and performing the covenants herein contained, Lessee shall peacefully and quietly have, hold, and enjoy the premises for the agreed term.

4. Use of Premises. The premises shall be used and occupied by Lessee for the purpose of vacationing. Lessee shall comply with all the sanitary laws, ordinances, rules, and orders of appropriate governmental authorities affecting the cleanliness, occupancy and preservation of the demised premises, and the sidewalks connected thereto, during the term of this lease. NO SMOKING IS ALLOWED IN THE UNIT

5. Number of occupants. Lessee agrees that the premises shall be occupied by no more than persons, consisting of adults and children, without prior consent of Lesser. Lessee is at least 25 years old and will be one of the occupants during the term of this lease.

6. Pet Clause. NO PETS OF ANY KIND are allowed on the property during the period of this lease agreement unless you are renting a unit which has been designated specifically as “Pet Friendly”.

7. Assignment and Subletting. Without the prior written consent of Lesser, Lessee shall not assign this lease, or sublet or grant any concession or license to use the premises or any part thereof.

8. Usage Disclaimer. Lesser shall have no liability to Lessee, Lessee’s family or Lessee’s guests for property damage or personal injury which may arise while occupying the premises and Lessee shall indemnify Lesser from any such claim arising during Lessee’s occupancy.

9. Cancellation Policy. If the lease and the security deposit listed in this contract have been returned and the rental is canceled before the full rent is paid, the deposit is forfeited. This deposit can be applied to another rental within the same calendar year. If the rent has been paid (30 days prior to arrival), and the rental is canceled, every effort will be made to re-rent the condo. If the condo is rented and full rental is received, the Lessee is relieved of the financial obligation and a refund will be made. If the condo is not re-rented, a refund consisting of the clean and taxes on clean ONLY will be sent to the lessee as these expenses will not have been incurred.

10. Hurricane or Storm Cancellation Policy. No refunds will be given unless: 1) The National Weather Service order mandatory evacuations in a “Tropical Storm/Hurricane Warning area” and/or 2) A “mandatory evacuation order has been given for the Tropical Storm / Hurricane Warning” area of residence of a vacationing guest. THE DAY THAT THE NATIONAL WEATHER SERVICE ORDERS A MANDATORY EVACUATION ORDER in a “Tropical Storm / Hurricane Warning,” area, we will refund: 1) Any unused portion of rent from a guest currently registered; 2) Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and 3) Any advance rents collected for a reservation that is scheduled to arrive during the “Hurricane Warning” period.

11. Conditions of Premises. Lessee agrees that upon completion of the lease term, all perishable items will be removed from the premises and properly stored in trash cans located outside the premises. All dirty dishes, cups, glasses will be placed in dishwasher and cycle started. Air conditioning or heating systems will be adjusted as indicated in the Welcome Letter you will be receiving upon arrival. Windows and doors will be secured upon departure.

12. Repairs and Maintenance. Guest understands that Dwelling is a privately owned home, condo or villa and is made available for rent. Should the dwelling experience a major maintenance issue, such as a failure in heating or air conditioning or a major appliance, or major repairs started by the Association for the building, Agent may provide guest with substitute comparable accommodations. In the event the Agent is unable to secure timely repair after notice of failure, a rate adjustment may be made at the discretion of the Agent at a rate not to exceed 10% of the daily rate. Agent also reserves the right to move guest to comparable accommodations, if deemed necessary by rental agent, with no rate reduction.

The Lessee has read and accepted the terms of the lease agreement indicating total payment of and the cancellation policy. IN WITNESS WHERE OF, the parties have executed this lease.
